These Terms and Conditions (“Terms”) govern your use of the NannyKit application, website, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. About NannyKit

NannyKit is a UK-based software-as-a-service (SaaS) platform that helps families manage the employment of their nanny. The Services may include (depending on your plan):

Step-by-step or automated set-up for HMRC registration, pension schemes, and insurance.

Payroll management and payslip generation.

Employment contract generation.

Salary and on-cost calculators.

Document management.

Nanny calendar and scheduling tools.

We provide tools, automation, and guidance. We do not provide legal, financial, or tax advice. You remain responsible for complying with all applicable laws as an employer.

2. Eligibility

To use the Services you must:

Be at least 18 years old.

Be resident in the UK.

Have authority to enter into a contract on behalf of yourself or your household.

3. Registration and Accounts

You must create an account to use the Services. You agree to:

Provide accurate, current, and complete information.

Keep your login details secure.

Notify us immediately if you suspect unauthorised access.

We may suspend or terminate your account if you breach these Terms.

4. Services and Limitations

Guidance only – NannyKit provides templates, guidance, and automation for compliance tasks. We do not act as your employer, tax agent, or legal adviser.

Third-party integrations – Our Services may integrate with third parties (e.g. HMRC, pension providers, insurers, payroll processors). We are not responsible for their performance, terms, or policies.

Accuracy – While we aim to keep our tools accurate and up to date, we cannot guarantee that calculations, forms, or outputs will be error-free. You are responsible for verifying compliance with HMRC and other regulators.

Service availability – We strive for continuous availability but do not guarantee uninterrupted or error-free access.

5. Pricing and Payment

Subscription fees are payable in advance as set out on our website.

Payments are processed securely via third-party providers.

All fees are exclusive of VAT unless stated otherwise.

We may change our pricing at any time, but will give you reasonable notice before changes apply.

No refunds will be given for partial subscription periods except as required by law.

6. Your Responsibilities

You agree to:

Use the Services only for lawful purposes.

Ensure all information you provide is accurate and up to date.

Comply with your obligations as an employer under UK law (including HMRC filings, pension contributions, and insurance requirements).

Not misuse the Services (e.g. reverse-engineer, attempt to gain unauthorised access, or use it to manage non-domestic employment).

7. Intellectual Property

All intellectual property rights in the Services belong to NannyKit or its licensors.

We grant you a limited, non-exclusive, non-transferable licence to use the Services for personal household use.

You may not copy, modify, distribute, or create derivative works of our Services without our written consent.

8. Data Protection and Privacy

Our use of your personal data is governed by our Privacy Policy. By using our Services, you consent to our collection and processing of personal data in accordance with UK GDPR and the Data Protection Act 2018.

9. Liability

No liability for reliance – NannyKit is a tool, not a substitute for professional advice. You are responsible for verifying compliance.

Exclusions – To the fullest extent permitted by law, we exclude liability for:

Loss of profits, revenue, or savings.

Indirect or consequential loss.

Errors caused by third-party providers or incorrect data you submit.

Cap on liability – Our total liability to you for all claims in any subscription year shall not exceed the fees you paid to us in that year.

Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

10. Cancellation and Termination

You may cancel your subscription at any time via your account settings; cancellation will take effect at the end of the current billing period.

We may suspend or terminate your account immediately if you breach these Terms or misuse the Services.

11. Changes to Services or Terms

We may update the Services or these Terms from time to time. If we make significant changes, we will notify you via email or through the app. Continued use after changes take effect constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
